Sara Sharif’s father should serve whole life order, court told

The Court of Appeal was told that Sara Sharif’s father should provide a whole order for his daughter’s murder.

Urfan Sharif and Beinash Batool were sentenced to life in December, 40 and 33 years after being convicted of murder of a 10-year-old man.

Sara’s uncle Faisal Malik was found guilty of causing or allowing death and sentenced to 16 years in jail. All three are seeking leave to file a verdict, but the Deputy Attorney General wants Sharif’s verdict to increase.

During hearings on all aspects of the judgment, Tom Little KC told the deputy attorney general that Sara’s murder was a rare case, namely “an unusually high degree of seriousness” that gave Sharif a lifetime order.

After serving a minimum term of sentence, someone can release life sentences in prison, but the entire life order means that a person can never be released unless in a special compassionate situation.

The appeals court judge, Lucy Rigby KC MP, heard the application, saying Sharif’s decision for at least 40 years was “too tolerant”.

Sara was found dead in a family home in Woking, Surrey in August 2023.

She suffers 71 people were injuredincluding 25 fractured bones, iron burning at her bottom, footprint marks and human bites.

In filing a written submission to the Court of Appeal, the Deputy Attorney General said that it was wrong for the judge to impose a lifelong order on Sharif.

These facts, she said, are “the most terrifying and widespread torture in the victim’s own home.”

At the same hearing, Sharif, Balk and Malik appeared alone through the prison.

The applicant must obtain permission from the judge or “leave” before he can file an appeal against the judgment.

Naeem Mian KC argued to Sharif that his client’s existing life sentence is 40 years “apparently it’s an overdue”.

Mr Mian KC told the court that there are few arguments that this is a case that takes a 30-year starting point, but Sharif’s behavior after Sara’s death does not guarantee that the judgment will rise to 40 years.

For Batool, Caroline Carberry KC told the court that her client’s judgment was “not a fair and proportional judgment.”

Ms. Carberry KC said Batool’s culprit was “significantly lower than her husband’s culprit, and the trial judge did not give her a significant impact on the “secondary role”.

Michael Ivers KC told Malik that his verdict did not correctly reflect the factual findings of the sentencing judge.

He said the judge was because Malik sentenced Malik because he did not cause Sara’s death, but did not take reasonable measures to prevent Sara.

The hearing continues.
