Charlotte Tilbury is a British beauty company founded in 2013 by the businesswoman of the same name. As of 2023, the company has experienced considerable growth, with revenue approaching £450 million ($560 million) that year. Its products are sold in 76 countries around the world, but its alleged business practices in the United States have put it in legal trouble.
In September, the company agreed to pay a $2.925 million settlement to resolve a class-action lawsuit alleging that it retained certain data on customers who used various online “try-on” tools without their consent, violating Illinois’ Biometric Privacy Act.

Why is Charlotte Tilbury Beauty being sued?
Charlotte Tilbury was initially hit with a class action lawsuit in Cook County, Illinois in April 2023. The complaint focused on various virtual try-on tools provided by the company, including but not limited to Charlotte’s Virtual Try On, Pro Skin Analysis, Foundation Shade Finder, Skin tone editor, highlight shade finder, how to apply, blush finder and skin reader.
The lawsuit alleges that the company violated Illinois biometric privacy laws by retaining scans of the facial geometry of people using these virtual tools without their consent. Although the company has agreed to pay a $2.925 million settlement, it has not admitted any wrongdoing.
Who is eligible for a class action settlement?
The settlement is open to Illinois residents who used one of Charlotte Tilbury’s virtual try-on tools between December 1, 2019, and August 31, 2023.
The settlement is expected to range from $700 to $1,100, depending on how many people choose to participate.
What is the deadline for settlement of this class action lawsuit?
Anyone who believes they are eligible for this settlement must submit a valid claim by January 2, 2025, which they can do by: Fill out the online form here. It’s unclear when the payments will be sent, but a final hearing in the case is scheduled for February 26, 2025.
