MP’s prison term suspended on appeal

Congressman Mike Amesbury admitted to repeated assaults on members in the street and suspended 10 weeks of jail after appeal.
Last year in Frodsham, Cheshire, Runcorn and Helsby MP attacked 45-year-old Paul Fellows and were jailed by a magistrate on Monday.

Judge Everett told Amesbury that facts showed him “a real unfavorable light” and that as a member of Congress, he “should be a role model.”
The judge said that while admitting he was a member of Congress was wrong with a different judgment, the judge added: “This does not mean that we cannot consider your actions as a member of Congress are simply shameful.”
He said he could not ignore Amesbury’s “drinking and fighting.”
The former labor politician arrived at the courthouse in a prison van and handcuffed into the building.
In a prepared statement issued in a police interview, Amesbury claimed he had been “screamed” by a man about local and national affairs, the court heard.
The MP said that because he was scared, another person’s “weapons were swaying”, he felt that he had no choice but to “defend” himself.

But the judge told him that CCTV pictures revealed a completely different story.
“You actually told the police a pack of lies. That’s all,” he said.
Judge Everett questioned why the prosecution did not file a lawsuit (can carry a longer sentence).
Daniel Travers, who defends Amesbury, told the court: “He has three nights in jail now, which is an experience he will never forget.”
He said “public humiliation” and “embarrassment” had a huge impact on his clients.
“This is someone who will definitely recover,” Mr. Travers said. “He will learn a very painful lesson.”
“Recall Petition”
Amesbury’s imprisonment confirmation, even if it has been suspended now, could still lead to his removal.
The long-time labor politician has been an independent MP for the past four months after the party boss was suspended.
Under parliamentary rules, a “recall petition” is triggered if a member of Congress accepts a sentence of detention.
Hearing the Speaker of the House of Commons at Chester Crown Court, the Returning Officer of the Runcorn and Helsby constituencies in Amesbury.
Voters will then have six weeks to register at 10 nominated places, requiring them to be removed from office.
If at least 10% of people vote to remove Amesbury, a by-election will be called.
This will be the first by-election under the New Labour government.
Amesbury comfortably won the newly created Labour seat in the July general election, garnering 53% of the vote.
Britain’s reforms accounted for 18%, defeating the Conservatives (16%) to rank second.
